1. Who Zappy is

Zappy Care, PBC is a Delaware public-benefit corporation. We operate this website and the Zappy member portal. Medical services are provided by independent professional medical groups whose clinicians are licensed in your state.

2. Eligibility

You must be 18 years or older, a U.S. resident in a state where Zappy operates, and able to enter into binding contracts.

3. Medical relationship

Your relationship with the prescribing clinician is between you and the clinician (and their professional medical group). Zappy is the technology and operations layer that supports the clinical relationship; it is not itself the prescriber.

4. Not for emergencies

Zappy is not for medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number. For poison-related concerns, call 1-800-222-1222.

5. Accuracy of information

You agree to provide accurate, current, and complete information during the intake and on an ongoing basis. Medical decisions are based on the information you provide; inaccurate information may lead to inappropriate care.

6. Payments and billing

Subscription fees are charged monthly in advance. Visit fees are charged at the time of submission. We do not bill insurance. You authorize us to charge the payment method on file for active subscriptions until paused or canceled.

8. Prohibited uses

You may not: misrepresent your identity or medical history; resell or transfer medications; tamper with the platform; use Zappy for any unlawful purpose.

9. Intellectual property

All content on this site (text, images, code) is owned by Zappy Care, PBC or its licensors. You may not reproduce, modify, or distribute it without written permission, except for personal use.

10. Disclaimer of warranties

The service is provided "as is." We make no warranties as to specific clinical outcomes; medicine is not a guaranteed-outcome business.

11. Limitation of liability

To the maximum extent permitted by law, Zappy's liability for any claim arising out of the service is limited to the amount paid to Zappy in the 12 months preceding the claim.

12. Arbitration and dispute resolution

Disputes arising out of these terms are resolved by binding arbitration under the rules of the American Arbitration Association, on an individual (non-class) basis, with limited exceptions. You may opt out of arbitration within 30 days of agreeing to these terms by emailing legal@zappyhealth.com.

13. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

14. Changes to these terms

We may update these terms from time to time. Material changes will be notified to active members at least 30 days before they take effect.
